Important: Mahalo Travels is not a travel agency and does not book flights, hotels, or other travel services directly. We connect you with travel professionals who handle bookings.

3. Account Responsibilities

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your password and account
• You must notify us immediately of any unauthorized use of your account
• You must be at least 13 years old to create an account
• One person or entity may not maintain more than one account
• You are responsible for all activity that occurs under your account

4. Intellectual Property

All content on Mahalo Travels — including text, graphics, logos, icons, images, AI-generated itineraries, software, and design — is the property of Mahalo Travels or its content suppliers and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission, except for personal, non-commercial use of itineraries generated for you.

5. User-Generated Content

When you submit content to our platform (reviews, trip sharing, comments, photos), you:

• Retain ownership of your content
• Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with our services
• Represent that your content does not infringe on any third party's rights
• Agree that we may remove content that violates these Terms

• We are not responsible or liable for the actions, services, cancellations, delays, injuries, losses, damages, refunds, or any other matters related to trips, travel suppliers, third-party operators, or experiences provided by them
• All bookings, contracts, and travel arrangements are made directly between the traveler and the independent travel agent or supplier
• We are not responsible for the actions, quality of service, or reliability of any travel agent, supplier, or third-party provider listed on our platform
• We are not liable for travel outcomes, including cancellations, delays, schedule changes, lost luggage, illness, injury, or changes made by airlines, hotels, cruise lines, or other providers
• Travel involves inherent risks, and by using this site, you acknowledge and accept those risks
• Our total liability for any claim arising from our services shall not exceed $100 USD
• We are not liable for any indirect, incidental, special, consequential, or punitive damages of any kind

10. Disclaimers

• All prices, quotes, itineraries, and recommendations displayed on Mahalo Travels are estimates only and may not reflect current rates or availability
• Travel pricing changes daily based on seasonality, fuel costs, taxes, fees, supplier rates, and demand
• Estimates do not include taxes, gratuities, travel insurance, ground transfers, port fees, resort fees, or optional add-ons unless explicitly stated
• Final pricing must be confirmed with one of our travel agents before booking
• AI recommendations are suggestions based on available data and algorithms — they are not guarantees of quality, availability, or suitability
• Deal information is sourced from third parties and may be inaccurate, expired, or unavailable
• Our services are provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that our services will be uninterrupted, error-free, accurate, complete, or secure

11. Indemnification

You agree to indemnify, defend, and hold harmless Mahalo Travels and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of our services, violation of these Terms, or infringement of any third party's rights.
